Topic: A detailed discussion of the False Claims Act (FCA) and its impact on the emergency response and remediation industry, particularly those companies involved with federal, state, or local governments.  The presentation will also go through the impacts of some major Supreme Court decisions for the industry from this year, specifically Loper Bright and Corner Post, and what they may mean for future challengers of regulations and their implementation. The highlights expected to be addressed include: 

  • What is the False Claims Act? Why does it matter?  
  • What conduct does the False Claims Act address?
  • Are there any ways to mitigate the risk of a violation?
  • What did Loper Bright and Corner Post change for the world of False Claims Act defense or more generally?
  • How may Loper Bright and Corner Post affect future challenges in practice? 

Presenter: Alexander Gorelik is a SCAA Member and an attorney in Taft’s Government Contracts practice group in the Washington, D.C. office. He focuses his practice on government contracts and construction litigation.
